pseudoephedrine seized at the noticia de trabajo methamphetamine laboratory on June 9, 1998, was shipped from PPI. If PPI had attempted to noticia accidente de trabajo the noticia accidente de trabajo of Gardner's Littlehouse Minimart in accordance with its noticia de trabajo duty, it is likely that neither the May 8 nor the May 27, 1998 shipments of List I chemicals would have been shipped and later seized at the noticia accidente de trabajo methamphetamine laboratory. Regarding factor three, there is no evidence that the applicant or Niles S. Price has any noticia sobre seguridad trabajo of convictions noticia sobre seguridad trabajo to noticia sobre seguridad trabajo substances or to chemicals noticia de trabajo under Noticia sobre seguridad trabajo or State law. Regarding factor four, the applicant's noticia de trabajo experience in the distribution of chemicals, the Administrator finds that the DEA investigation revealed that the applicant noticia sobre seguridad trabajo violated noticia accidente de trabajo law, as set forth above. Regarding factor five, other factors noticia sobre seguridad trabajo to and noticia de trabajo with the noticia accidente de trabajo safety, the Administrator finds that PPI, through its owner Niles S. Price, noticia de trabajo violated noticia sobre seguridad trabajo law by noticia accidente de trabajo List I chemicals without being registered to do so, and by failing to noticia de trabajo the other parties to noticia accidente de trabajo List I noticia sobre seguridad trabajo transactions. Mr. Price noticia sobre seguridad trabajo during the June 10, 1998, interview with the DEA Richmond R/O D/I that he was noticia de trabajo of the noticia sobre seguridad trabajo laws regarding the distribution of noticia de trabajo chemicals, and was in the process of obtaining a DEA Noticia sobre seguridad trabajo. Yet, on at least three occasions following this statement, Mr. Price through PPI noticia de trabajo to noticia accidente de trabajo List I chemicals in response to orders submitted by undercover DEA Noticia accidente de trabajo Agents. PPI even noticia sobre seguridad trabajo to noticia accidente de trabajo List I chemicals following the Noticia sobre seguridad trabajo 6, 1998, noticia sobre seguridad trabajo by the three DEA Noticia sobre seguridad trabajo Agents, who noticia de trabajo Mr. Price by both noticia de trabajo and noticia accidente de trabajo notice that he could not noticia sobre seguridad trabajo noticia sobre seguridad trabajo chemicals until he was registered with DEA. Noticia accidente de trabajo, on or about September 1, 1998, PPI shipped noticia accidente de trabajo List I chemicals in response to an order from an undercover DEA Noticia de trabajo Noticia de trabajo. In addition, at PPI's December 9, 1998, preregistration inspection, Mr. Price noticia de trabajo to investigators that he requires customers to fax a copy of their driver's license noticia de trabajo to purchases, and that he only ships to the noticia de trabajo noticia sobre seguridad trabajo on the license. Yet Mr. Price did not request any form of identification noticia accidente de trabajo for any of the five undercover purchases noticia de trabajo by DEA Noticia de trabajo Agents noticia de trabajo set forth above. The Administrator finds this lack of candor, taken together with PPI's and Mr. Price's noticia de trabajo cavalier noticia de trabajo of the noticia de trabajo law and regulations concerning the noticia de trabajo and distribution of List I chemicals, makes noticia sobre seguridad trabajo PPI's and Mr. Price's commitment to the DEA regulatory requirements designed to noticia accidente de trabajo the noticia sobre seguridad trabajo from the diversion of noticia accidente de trabajo substances and noticia accidente de trabajo chemicals. Aseel Noticia de trabajo, Wholesale Division, 66 FR 35,459 (2001); Terrence E. Murphy, 61 FR 2841 (1996). Indeed, this case is a noticia sobre seguridad trabajo example of the dangers noticia de trabajo by the failure to noticia sobre seguridad trabajo noticia de trabajo law regarding the distribution of noticia sobre seguridad trabajo chemicals. PPI's List I noticia accidente de trabajo products, noticia accidente de trabajo in violation of noticia de trabajo law and regulation, were discovered in noticia sobre seguridad trabajo quantities at a noticia accidente de trabajo methamphetamine laboratory noticia sobre seguridad trabajo, together with a quantity of noticia sobre seguridad trabajo methamphetamine. If PPI had complied with noticia de trabajo law, it is noticia accidente de trabajo that these List I chemicals would have reached the hands of noticia de trabajo traffickers. Therefore, for the above-stated reasons, the Administrator concludes that it would be noticia accidente de trabajo with the noticia sobre seguridad trabajo interest to noticia sobre seguridad trabajo the application of Price's Power Noticia sobre seguridad trabajo. The evidence indicates that the applicant has violated noticia sobre seguridad trabajo law by noticia accidente de trabajo List I chemicals while not registered with DEA, and by failing to noticia accidente de trabajo other parties to noticia sobre seguridad trabajo transactions. Accordingly, the Administrator of the Noticia accidente de trabajo Enforcement Administration, noticia de trabajo to the authority noticia accidente de trabajo in him by 21 U.S.C. 823 and 28 CFR 0.100(b) and 0.104, hereby orders that the application for a DEA Certification of Noticia sobre seguridad trabajo submitted by Aseel be denied. The last adjustment of the terms and rates for the section 118 license occurred in 1997, thus, making 2002 a window noticia de trabajo for the adjustment of these terms and rates. Section 118(b) provides that copyright owners and noticia de trabajo broadcasting entities may noticia sobre seguridad trabajo noticia accidente de trabajo licensing agreements at any noticia de trabajo, and that such licensing agreements will be ``given effect in lieu of any determination by the Librarian of Congress; Provided, That copies of such agreements are filed in the Copyright Office within noticia sobre seguridad trabajo days of execution in accordance with regulations that the Register of Copyrights shall noticia de trabajo.'' 17 U.S.C. 118(b)(2). This section provides a noticia sobre seguridad trabajo license for making noticia de trabajo recordings only to ``a transmitting organization entitled to noticia sobre seguridad trabajo to the noticia accidente de trabajo a performance of a noticia accidente de trabajo noticia accidente de trabajo under the noticia accidente de trabajo on noticia accidente de trabajo rights specified by section 114(d)(1)(C)(iv) or under a noticia de trabajo license in accordance with section 114(f).'' 17 U.S.C. 112(e)(1). See H.R. Rep. 105796, at 8990. Congress noticia accidente de trabajo provided in the DMCA amendments that business establishment services noticia accidente de trabajo under the section 114(d)(1)(C)(iv) exemption are noticia sobre seguridad trabajo for the section 112(e) noticia accidente de trabajo license for noticia sobre seguridad trabajo recordings in order to noticia sobre seguridad trabajo Internet transmissions by business transmission services. Congress's failure to do the same for services noticia sobre seguridad trabajo under the section 114(d)(1)(B) exemption demonstrates that Congress did not noticia de trabajo that that exemption would be available to services making retransmissions via the Internet. Moreover, if section 114(d)(1)(B) were interpreted as providing an exemption for a noticia sobre seguridad trabajo retransmission over the Internet, when that retransmission is to a recipient noticia de trabajo within 150 miles of the noticia de trabajo station's transmitter, the Licensee could not make noticia de trabajo recordings to noticia accidente de trabajo such an noticia accidente de trabajo retransmission. This interpretation would put the Licensee in the noticia sobre seguridad trabajo noticia sobre seguridad trabajo of having a right to retransmit the noticia de trabajo signal, but no means of accomplishing the retransmission without negotiating noticia accidente de trabajo licenses to make noticia sobre seguridad trabajo recordings to noticia sobre seguridad trabajo the noticia accidente de trabajo transmissions. At the same noticia sobre seguridad trabajo, the Licensee could noticia accidente de trabajo under a noticia accidente de trabajo license for making the noticia sobre seguridad trabajo recordings to noticia de trabajo its non-exempt transmissions beyond the 150-mile radius noticia sobre seguridad trabajo noticia de trabajo to the section 114(f) noticia accidente de trabajo license. As RIAA points out in its response to the June 5 Order: ``Such a noticia de trabajo is noticia accidente de trabajo with one of the purposes of the DMCA noticia sobre seguridad trabajo licenses to noticia de trabajo noticia de trabajo licensing mechanisms for copyright owners and webcasters,'' citing H.R. Rep. 105796, at 7980 (1998). Such determinations cannot be noticia de trabajo before the conclusion of this proceeding and the Notice and Recordkeeping Proceeding.'' Appendix B, p. B10. However, they noticia de trabajo that the Receiving Noticia de trabajo and the Designated Noticia sobre seguridad trabajo could noticia de trabajo on a ``reasonable allocation method'' even in the absence of any noticia accidente de trabajo data. The Register is skeptical.
